Acceptable Use Policy

This Acceptable Use Policy (“AUP”) establishes the guidelines for the use of Galaxy Nexus’s services by the client (“Client”). The primary objective of this comprehensive AUP is to maintain a secure, stable, and high-performance hosting environment, while strictly prohibiting any malicious activities that could harm the infrastructure or other clients.

1. Prohibited Activities

  • Malicious Software: Hosting, distributing, or transmitting any malicious software, malware, or any other harmful code that could compromise the security of the hosting environment or other clients’ data.
  • Hacking and Unauthorized Access: Attempting to gain unauthorized access to systems, networks, or accounts, or engaging in any form of hacking, penetration testing, or vulnerability scanning without prior written authorization.
  • Spam and Unsolicited Communications: Sending unsolicited emails or messages, including phishing, scams, or any other fraudulent activities that could negatively impact recipients or tarnish Galaxy Nexus’s reputation.
  • Illegal Content: Hosting, distributing, or transmitting any content that is illegal, offensive, defamatory, or violates intellectual property rights, copyright, or trademark laws.
  • Denial of Service (DoS) Attacks: Engaging in any activity that attempts to disrupt the availability or functionality of services, including Distributed Denial of Service (DDoS) attacks.
  • Botnets and Command & Control Servers: Hosting or operating botnets, command and control servers, or any other infrastructure designed for malicious purposes.
  • Pharming and DNS Spoofing: Redirecting users to fraudulent websites or manipulating DNS settings to deceive or compromise users’ security.

2. Resource Usage and Performance

Client agrees to use allocated resources responsibly and not engage in activities that may cause resource exhaustion, degrade performance, or negatively impact other clients’ experience. Any excessive consumption of resources that disrupts the hosting environment will result in immediate corrective actions, including possible suspension of services.

3. Compliance with Legal and Regulatory Frameworks

Client is obligated to adhere to all local, national, and international laws, regulations, and applicable industry standards. Any activities that violate these laws or regulations will result in the suspension or termination of services, without refund.

4. Data Protection and Privacy

Client must respect the privacy and confidentiality of personal and sensitive data. Client acknowledges that Provider is not responsible for any data breaches caused by Client’s negligence or non-compliance with data protection regulations.

5. Reporting Violations

Clients are encouraged to report any suspected violations of this AUP to Galaxy Nexus’s Abuse Department promptly. Failure to report violations may result in Client being held liable for any damages resulting from the violation.

6. Suspension and Termination

Provider reserves the right to suspend or terminate services immediately and without notice in cases of AUP violations or activities that endanger the hosting environment, other clients, or Provider’s reputation. No refunds shall be provided in such instances.
